A Disclosure Document, Franchise Agreement, and Operations Manual are needed in order to franchise a business. The Franchise Disclosure Document (FDD) has replaced the older "UFOC". The Disclosure Document is mandated by the FTC Rule. Disclosure Documents are a summary of the information which needs to be disclosed to the prospective franchisee for the franchisee to make an informed decision concerning his investment in a franchise. We have written our Disclosure Documents to state all material facts in an accurate and unambiguous manner, and to state it clearly, concisely and in a narrative form that is understandable by a person unfamiliar with the franchise business. Our Disclosure Document, and Franchise Agreement avoid technical language, repetitive phrases, and unnecessary detail. We use a chronological order of items whenever possible. We do not reference to another document ( unless you have purchased our Area Developer, Master Franchiser, or Mini-store, shop, or service Franchise Agreements) other than the Franchise Agreement, and then by number reference. Separate documents such as the Operations Manual do not make representations, or impose terms that contradict, or are materially different from the Franchise Disclosure Document.
The Franchise Agreement is the legal agreement between the Franchisor and Franchisee. It prescribes the assigned Franchisee's territories, fee structures, and what the Franchisor expects from the Franchisee. It details the duties of the Franchisor in regards to the Franchisee, and the duties of the Franchisee in regards to the Franchisor.
Our Disclosure Document and Franchise Agreement have been drafted carefully to favor the Franchisor, since they are the cornerstone of the business system offered by the Franchisor.
